Competition Rules
DEADLINE FOR SUBMISSIONS: AUGUST 15, 2009, 11:59 p.m. (Pacific Standard Time)
Eligibility
1.0 The Competition is open to all persons 18 years of age or older who are in the Ismaili community (this includes non-Ismaili spouses, partners and children) with the exception of all employees of ISM Global Creations Inc.
If you're under 18 and would like to submit an Image, a parent or guardian can do so on your behalf.
Acceptance & Privacy Pledge
2.0 By entering The Competition you accept these Competition Rules. Entries not complying with the Competition Rules or a submission of an incomplete Entry Form will be disqualified.
2.1 By entering The Competition, you agree and acknowledge that ISM Global Creations Inc. is permitted to receive your registration information. ISM Global Creations Inc. will keep your personal information confidential. We will use this information only for the purpose of The Competition. Please see the Privacy Policy for more information.
Ownership of Images
3.0 You warrant and represent that the Image(s) entered is your own original work (or submitting on behalf of your Child, the original work of your Child) that you alone (or your Child) own copyright to the Image(s). Therefore, participants hold ISM Global Creations Inc., their Employees, Family Members and Sponsors harmless from any breech of copyright in Canada, the USA, and worldwide from consequential litigation.
Image Format and Procedure
4.0 No purchase is necessary to participate in the ISM Photography Competition.
4.1 You may submit a maximum of ten Images. Any Images in excess of the first ten will be disqualified.
4.2 Entries must appropriately be placed in one of the following categories:
- AROUND THE WORLD - Show us who Ismailis are, who you are and who your family and friends are.
- CULTURE - Show the diversity in our Ismaili culture from food and clothing to arts and celebrations. Tell us a tale through your Images.
- LOVE - Show us through your Images what love means to you.
- HABITAT - Show us where Ismailis live, your home, city, country from urban to nature.
- COMMUNITY SERVICE & VOLUNTEERING - Show us how Ismailis make a difference.
4.3 Digital Images must meet the following requirements:
- JPEG (.jpg or .jpeg) format
- Colour or Black & White (RGB)
- Image file name format: Imagetitle_ImageNumber.jpg (i.e. KenyaSafari_Image1.jpg). File names that contain brackets () or any special characters will not be accepted.
- Maximum Image file size: 5 megabytes
- 300 dpi resolution or at the highest resolution and quality provided by your camera
- Minimum size: 5" x 7" (1500 x 2100 Pixels); Maximum size: 9" x 12" (2700 x 3600 Pixels)
- Manipulated Images will be excluded from The Competition however minor burning, dodging and/or colour correction is acceptable.
4.4 You are solely responsible for obtaining releases for images that contain recognizable people, original works of art or taken on private property. You hold ISM Global Creations Inc., their Employees, Family Members and Sponsors harmless from any breech of copyright in Canada, the USA, and worldwide from consequential litigation.
4.5 Your entry may be uploaded directly via the internet or by mail.
4.5.1 Your images and entry form will not be returned.
4.5.2 ISM Global Creations Inc. assumes no responsibility for any technical issues or failure when uploading Images or for damage, loss, or delays that might occur during transportation.
Judging
5.0 Entries will be judged on the basis of creativity, relevance to theme and quality of Image.
5.1 All judges will be selected by ISM Global Creations Inc. The winners will be determined by the judges and ISM Global Creations Inc. in accordance to the Competition Rules.
5.2 The decision of ISM Global Creations Inc. is final and no negotiation will be entered into with respect to any such decision.
Winners
6.0 Prize winners will be notified of their win, in writing within 60 days of judging, either by mail or e-mail. Winning Images and Honourable Mentions will be published online on September 21, 2009. Images selected to be published in the Coffee Table Book will be acknowledged.
6.1 Please do not inquire about the status of your submission.

7.0 ISM Global Creations Inc. has the right to substitute the prizes at equal, greater or less value without notice. Prizes are not transferable and no cash equivalent will be offered. Winners will be given 48 hours to accept the prize before another grand prize, first, second or third prize winners are selected.
7.1 Prizes will be sent within 120 days after the closing contest date through Canada Post and will include those delivery guarantees provided by Canada Post Corporation. Duty and Custom fees will be the responsibility of prize recipients.
Disqualification
8.0 ISM Global Creations Inc. has the right, in its sole discretion, to disqualify and remove any entry that does not comply with the following requirements even after the entry is submitted on the website or by mail. You assure and represent that each Image submitted by you is as follows:
8.1 Each Image does not contain his Highness the Aga Khan or his family members.
8.2 Each Image does not contain obscene, provocative, pornographic, false, abusive or any other objectionable content.
8.3 Each Image does not contain content that encourages criminal offence, gives rise to civil liability, or violates any law.
8.4 Each Image does not infringe upon copyrights, trademarks, contract rights, or any other intellectual property rights of any third party or entity, or violate any person’s rights of privacy or publicity and your Image does not include the following:
8.4.1 Trademarks and copyrighted materials owned by third parties.
8.4.2 Names or characteristics identifying public figures.
8.4.3 Images in which You have purchased the rights to use stock images.
8.4.4 Images which contain any commercial content that promotes any product.
8.4.5 Images that have previously won any competitions.
8.5 You agree to fully indemnify ISM Global Creations Inc. in respect of all royalties, fees and any other monies owing any person by reason of your breaching any of the above.
Rights Granted
9.0 You grant ISM Global Creations Inc. the following worldwide, royalty-free and irrevocable rights:
9.1 To copyright the photograph in the name ISM Global Creations Inc.
9.2 To use and re-use, publish and re-publish the photograph, in whole or in part, in any medium or any media for any purpose (except pornographic or defamatory), which may include (but not limited to) books, advertisements, websites, promotion, marketing and packaging or any product or service. You agree that the photograph may be combined with text, graphics or other images. Furthermore, You will hold harmless ISM Global Creations Inc. of any liability by virtue of any alterations that may be required, and colour that may occur in reproducing any photographs. You agree that ISM Global Creations Inc. has no duty to show You any photographs produced prior to using or distributing the material in any form.
9.3 You hereby remiss, release, acquit and forever discharge ISM Global Creations Inc., all of its Sponsors and each of their respective heirs, executors, beneficiaries, administrators, successors and assigns, directors, officers, partners, associates, employees and agents (collectively referred to as "ISM Global Creations and Sponsors"), of and from any and all actions, causes of actions, claims, debts, dues, accounts, representations, warranties, obligations and demands, or claims for damages, costs, interest, expenses or loss (collectively, "Claims") whatsoever and howsoever arising which You may now or hereafter have in consequence of or in any way related to the use by ISM Global Creations of the photograph for the purposes described above, and includes any Claims of libel, breach of copyright or invasion of privacy and Claims not known or anticipated but which may arise in the future.
